Vendors Agreement for Events

This Vendor Agreement (the “Agreement”) is entered into between Tercer Cielo LLC known as Cielo Mystic, represented by its Director John Catana, and the undersigned performer (“Performer”) participating in the event as a volunteer or vendor. This Agreement outlines the terms and conditions that all participants must adhere to in order to ensure a successful event aligned with the Event’s mission statement and brand ethics. Please read and understand this Agreement carefully before signing.

• Mission Statement Adherence: The Vendor acknowledges and understands the Event’s mission statement, which aims to create an environment where aspiring businesses can have the opportunity to sell publicly, allowing them to build their business and brand. By participating in the event, the undersigned agrees to support and uphold this mission statement:

• No Smoking or Drinking Policy: Smoking is strictly prohibited within the event space. The undersigned agrees not to smoke or use any marijuana products within the space of the event. Any smoking or recreational use must be down at least 100 feet from the event space and away from public view. Drinking is strictly prohibited and participants who are found to be smoking, drinking or providing alcohol to anyone in the event or themselves will be banned indefinitely. The use of marihuana although publicly legal in NJ, is prohibited at our events. Neighbors and local constituents have agreed to allow us to use their street for our events and festivals, their requirement is to adhere to these rules. Vendors found to be violating these rules could potential be subjected to police removal and will have their vending fee voided and non refundable. Vendors who violate this rule are also barred from participating at future events

• Service and Vendors Fee: We at Cielo Mystic believe that vending should be affordable and available to all developing business. We provide the opportunity for 10 first time vendors to recieve free vending at our events. Each free vendor would be interviewed to determin eligabilty fro free vending. Vending Fees allow our mission to continue

The standard Vending fee shall be $59 for a tent space 10x10ft where vendor provides their own tent, table and chair. 

Electricity is not required and vendors are encouraged to provide their own if means are possible.

Neighborhood vending clause: Vendors that are neighbors of the events setting, that live on the block where the event is taking place, are not subject to vending fees if they use the space directly in from of their house. Neighbors are encouraged to participate in our annual events and will not be charged any vending fees

Vending fee Cancellation: Vending fees are non-refundable as well as any other fees for amenities are considered final. All fees are considered a final sale once the terms and agreement have been approved. Violation of our mission statement, terms and conditions or our ethics will result in a forfeit of your vending fees and may result banning from future events

• Brand Representation: The Performer acknowledges that they are an extension of the Event’s brand. Therefore, they agree to behave morally,  and in alignment with the Event’s brand ethics throughout their involvement in the event. This includes demonstrating respect towards all participants, attendees, and brand partners.

• Respect for Performances: The Performer agrees not to heckle, distract, or hinder any other performance taking place during the event. They will show support and respect for fellow performers and their craft.

• Prohibition of Physical Altercations: The Performer understands that engaging in any physically aggressive behavior or altercations with other performers or brand partners is strictly prohibited. Any performer found to be involved in such incidents may be immediately dismissed from the event and banned from participating in any future performance opportunities associated with the Event.

• Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

• Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of New Jersey. Any legal action or proceeding arising out of or in connection with this Agreement shall be brought exclusively in the courts of Hudson county, NJ.

By signing below, the Performer acknowledges that they have carefully read and fully understand the contents of this Agreement and voluntarily agree to its terms.
